Terms of Service

1. Acceptance of Terms

By installing, accessing, or using BestCutPro software ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Software.

2. License Grant

Subject to these Terms and payment of applicable fees, BestCutPro grants you a limited, non-exclusive, non-transferable license to use the Software for your own personal or commercial video editing projects.

You may not:

• Copy, modify, or distribute the Software
• Reverse engineer, decompile, or disassemble the Software
• Sublicense, rent, or lease the Software
• Remove any proprietary notices or labels
• Use the Software for any illegal purpose

3. License Types

Single License: Permits installation on up to 2 devices for one user.

Team License: Permits installation for up to 5 users within the same organization. Each user must have a separate license seat.

Licenses are perpetual but bound to the license key. Reactivation may be limited based on the number of previous activations.

4. Payment and Billing

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. They provide all customer service inquiries and handle returns.

Prices are listed in USD and are subject to change with notice. Subscriptions renew automatically unless cancelled before the renewal date. You can manage your subscription through your Lemon Squeezy account.

5. Refund Policy

We offer a 14-day refund policy for new purchases. To request a refund, contact us at support@bestcutpro.com within 14 days of purchase.

Refunds are not available for:

• Requests made after 14 days from purchase
• Licenses that have been used to activate the software
• Partial months of subscription

6. Intellectual Property

BestCutPro and all related content, features, and functionality are owned by BestCutPro and are protected by copyright, trademark, and other intellectual property laws.

You retain all rights to your video content edited using the Software.

7. Third-Party Services

The Software may integrate with third-party services such as:

• AI transcription providers (OpenAI, Google Gemini, Deepgram)
• Stock media providers (Pexels, Pixabay)
• Payment processors (LemonSqueezy)

Your use of third-party services is governed by their respective terms and privacy policies.

8. Data and Privacy

Your use of the Software is also governed by our Privacy Policy. By using the Software, you consent to the data practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We disclaim all liability for any damages arising from your use of the Software.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BESTCUTPRO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE.

11. Termination

We may terminate or suspend your license at any time if you breach these Terms. Upon termination, you must cease all use of the Software.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BestCutPro operates, without regard to its conflict of law provisions.
